Expert Witness

An Expert Witness may be appointed to assist in construction disputes that arise between parties and may be appointed either by one of the parties to the dispute or as a single joint expert appointed by the court.

The appointed Expert is not an advocate for the party but has an overriding responsibility to assist the court in resolving disputes by providing an independent and impartial expert opinion based on the information available. Part 35 of the Civil Procedure Rules outlines the governance that must be adhered to by the Expert in the production of the report and their conduct throughout the process.

These Expert Witness reports can assist in adjudications, arbitral proceedings, tribunals and litigation.

However, Expert evidence has been the subject of much discussion following recent judicial criticism in the conduct of Expert Witnesses and their failure to adhere to their duty to the court.

John Grady has undergone the rigorous RICS Expert Witness training programme and is now a member of the RICS Register of Expert Witnesses.

Accordingly, he will operate and comply with the guidance set out in the RICS – Surveyors acting as Expert Witnesses 4th Edition and can provide independent and impartial opinion evidence on a variety of commercial matters as a quantum expert.
